Les personnes homosexuelles surprises « en train d’avoir des relations sexuelles » dans la province indonésienne d’Aceh, où la charia est en vigueur, seront passibles de 100 coups de bâton… Au même titre que le fait de s’adonner au jeu, de boire de l’alcool ou de tisser des liens d’affection entre personnes de sexe opposé en dehors des liens du mariage, ont annoncé les autorités.

Le décret qui entre en vigueur ce vendredi interdit explicitement la sodomie entre les hommes et le fait pour les femmes de « se frotter des parties du corps en vue d’une stimulation ».

Il s’applique à tous les musulmans, y compris aux étrangers, a déclaré à l’AFP le responsable provincial de la charia Syahrizal Abbas.

Ce châtiment est infligé en public au moyen de bâtons en rotin et vise davantage à humilier les condamnés qu’à leur faire mal physiquement. Il peut être remplacé par une peine de prison ou par le versement d’or.

Ce texte avait été adopté en 2014 au grand dam des défenseurs des droits de l’Homme. Les autorités islamiques se sont accordé un an pour informer les habitants de la teneur du décret avant qu’il n’entre en vigueur.

« Cette loi est destinée à sauvegarder la dignité humaine. Elle vise à empêcher les musulmans d’Aceh de commettre des actes immoraux », a ajouté Syahrizal Abbas.

Les relations homosexuelles ne sont pas illégales dans le reste de l’Indonésie, où s’applique un code pénal hérité du colonisateur néerlandais.

La province d’Aceh avait commencé à mettre en oeuvre la charia après avoir obtenu un statut d’autonomie en 2001, accordé par le gouvernement central à Jakarta en vue de mettre fin à plusieurs décennies de rébellion séparatiste.

L’Indonésie compte 225 millions de musulmans sur 250 millions d’habitants, qui pratiquent pour la majorité une forme modérée d’islam.

Under an Islamic bylaw, anal sex between men and “the rubbing of body parts between women for stimulation” is outlawed. The rule applies to all Muslims including foreigners, provincial sharia chief Syahrizal Abbas told AFP.

The regulation was passed in 2014 amid outrage from rights groups, but officials took a year to educate the public about the new law before it came into effect.

“The law is to safeguard human dignity. It is to protect Aceh’s Muslims from committing immoral acts,” Abbas said Thursday, adding it would come into effect the following day.

Gay sex is not illegal in the rest of the country, which mainly follows a criminal code inherited from former colonial ruler the Netherlands.

Aceh province, the only part of the world’s most populous Muslim-majority nation that is allowed to implement Islamic sharia law, already carries out public canings for gambling, drinking alcohol and fraternising with the opposite sex outside of marriage.

The new law in the western province also makes adultery punishable by 100 lashes and punishes those who accuse others of adultery without proof with 80 lashes.

Canings — which are carried out with thin rattan sticks in public and aimed at humiliating rather than causing physical pain — can be substituted with payments of pure gold or jail time.

Ismail Hasani, from prominent Indonesian rights group the Setara Institute for Democracy and Peace, criticised the law as “cruel, inhumane and against the constitution” and called for it to abolished.

“The government should not meddle in private affairs and instead guarantee individual rights such as freedom,” he added.

Aceh gained a degree of autonomy in 2001 in a deal with Jakarta aimed at quelling a decades-long separatist movement, and has been slowly implementing sharia law ever since.

The introduction of sharia laws has speeded up since Aceh struck a peace deal with the central government in 2005.
