Le touriste britannique Ray Cole, récemment condamné par la justice marocaine à quatre mois de prison pour “homosexualité”, a été remis en liberté mardi, a-t-on appris auprès d’une source ministérielle marocaine.
M. Cole, 70 ans, condamné en fin de semaine dernière, a été “remis en liberté aujourd’hui”, a indiqué cette source sous couvert d’anonymat, sans autre précision.
Selon des sources proches du dossier, qui ont également requis l’anonymat, il a été libéré après “avoir fait appel” du jugement. La date de cet appel n’a pas été précisée.
“Nous avons le plaisir d’annoncer que notre père, Ray Cole, a été libéré de prison et qu’il est en train de rentrer à la maison”, ont indiqué ses enfants sur la page Facebook dédiée à la campagne appelant à sa libération. Ils ont remercié “les autorités marocaines pour leur compassion”.
Ray Cole avait été interpellé par la police le 18 septembre à Marrakech, à un arrêt de bus, en compagnie d’un Marocain âgé d’une vingtaine d’années.
Selon un responsable de l’Association marocaine des droits humains (AMDH, indépendant), Omar Arbib, ils avaient eu, au préalable, “des gestes perçus comme étant à connotation sexuelle dans un centre commercial” de la ville.
“Le Marocain a nié toute relation sexuelle avec ce Britannique, affirmant être une connaissance de sa fille, diplomate”, a-t-il ajouté. “Mais des images ont été trouvées sur les téléphones portables des deux hommes”, condamnés à quatre mois de prison chacun, a poursuivi M. Arbib.
A l’inverse de Ray Cole, le ressortissant marocain se trouve toujours en prison, a précisé mardi soir ce responsable de l’AMDH, estimant qu’il devait lui aussi bénéficier d’une remise en liberté.
Lundi, le fils de M. Cole avait appelé les autorités marocaines à le libérer et une mobilisation avait vu le jour en Grande-Bretagne sur les réseaux sociaux.
Au Maroc, les actes homosexuels sont passibles de peines allant jusqu’à trois ans de prison.
Les poursuites contre des ressortissants étrangers pour de tels faits sont extrêmement rares, mais le site internet du Foreign Office met en garde les voyageurs homosexuels sur les risques: “L’homosexualité est une infraction pénale au Maroc”, est-il noté.

Ray Cole, 69, from Deal in Kent, was on holiday in Marrakesh last month to visit a Moroccan man, Jamal Jam Wald Nass.
But the pair were approached at a bus stop by police officers, and arrested under suspicion of homosexuality.
They were both sentenced to four months in jail after homosexual images were found on Mr Cole’s password-protected phone.
But tonight the retired magazine publisher has been released pending an appeal, it was confirmed.
In a statement, the Moroccan Embassy said: “Access to consular assistance and a legal defence has been duly provided to Mr Cole, who has exercised his right of appeal and is due to appear in front of the Judge of the Court of Appeals tomorrow, 8 October 2014.
“In the meantime, Mr Cole is to be granted conditional release. Today.”
The family of Mr Cole confirmed his release and said he is returning to the UK.
In a Facebook post they said: “We are delighted to announce that our dad, Ray Cole has been released from prison and is on his way home.
“We would like to thank each and every one of you, here and in Morocco who has helped our campaign to secure the release of our wonderful father.
“We would also like to thank the Moroccan authorities for showing compassion. We would ask that you allow us some time a family to absorb the news and to spend some time with dad.”
Mr Cole’s son, Adrian Cole, 41, had previously spoken of his concern for his father.
He said: “My father spoke to my mother yesterday and he was blown away when told of the level of interest and care and concern about him. He became quite tearful.”
