Objets contondants, boucles de ceinture et matraque… Sinthia Fernandez, 30 ans, et son compagnon, Isauro Aguierre, 37 ans, originaires de Palmdale en Californie, n’auront pas manqué d’imagination pour “guérir” le petit Gabriel, qu’ils soupçonnaient d’homosexualité. Ils avaient même réussi à lui faire sauter des dents. Un calvaire qui durait depuis des mois. Depuis qu’ils avaient obtenu en vérité la garde du garçon, jusque -là placé chez des proches compte tenu justement de l’instabilité du couple.
Gabriel avait d’ailleurs laissé une petite note dans sa classe évoquant son suicide, las d’endurer les abus, jusqu’à cette fameuse soirée… où ses parents l’ont aspergé de spray au poivre, l’obligeant ensuite à gober son vomi, sans pouvoir accéder à la salle de bain, avant de le terminer au fusil à pompe.
Déférés devant la justice, si les bourreaux ont échappé à la peine de mort, en changeant leur plaidoyer de « non-coupables » à « meurtre au premier degré » avec « tortures », ils écopent cependant de la prison à vie, sans remise de peine conditionnelle, renonçant également à leur droit d’appel.
Sur la page facebook mise en place pour réclamer « une justice » exemplaire, les soutiens du garçon se sont déclarés « satisfaits de la sentence » : « La peine capitale n’ayant pas été appliquée en Californie depuis presqu’une dizaine d’années, si le couple avait été condamné à mort, le procès aurait duré encore longtemps. »
Selon le plaidoyer, le couple ne sera pas placé en isolement mais enfermé en compagnie d’autres prisonniers… qui, comme on le sait, n’apprécient pas particulièrement les « tueurs d’enfants ». Justice ?!

Pearl Fernandez, who over an eight-month period assaulted Gabriel Hernandez with pepper spray, forced him to eat vomit, denied him use of the bathroom, beat him with a belt buckle and a metal bat, and shot him with a BB gun (among other unimaginable horrors) because he liked to play with dolls, initially pleaded not guilty to the charges, along with her boyfriend Isauro Aguirre.
But according to reports, in exchange for changing their plea to guilty of first degree murder and torture, the pair will spend life in prison without parole. They have also waived their right to an appeal.
Contributors to a Facebook page called Gabriel’s Justice are calling the development “a great thing,” citing the fact that California has not executed a prisoner in almost a decade and that a death-penalty trial would likely drag on for several years, providing “no closure for anyone.”
If there’s any justice for 8-year-old Gabriel, it’s that the plea will keep the killers out of solitary confinement and put them in the general prison population, where child abusers are said to be the most hated. And tortured.
