Roumanie : « 3 millions de signatures » et une proposition d’amendement constitutionnel contre le « mariage gay »

Plusieurs ONG roumaines, rassemblées au sein d’une « Coalition pour la famille », ont déposé au Parlement une proposition d’amendement constitutionnel visant à interdire les « mariages homosexuels ».

« Il s’agit d’une première historique : trois millions de Roumains, dans un énorme effort de solidarité, ont signé cette proposition d’amendement », a affirmé l’un des initiateurs, Mihai Gheorghiu.

Ces associations, liées à l’Église orthodoxe, appellent à l’organisation d’un référendum qui entérine le mariage comme « l’union librement consentie entre un homme et une femme », et non entre « époux », comme le prévoit actuellement la loi fondamentale.

« Le seul but de cette démarche est de monter l’opinion publique contre les personnes LGBT », car le code civil interdit déjà les mariages entre personnes de même sexe, souligne l’association de défense des droits des minorités sexuelles, Accept.

Cette « offensive » vise à « restreindre encore davantage les droits de ces minorités », a déclaré à l’AFP Florin Buhuceanu, membre d’Accept, dénonçant une « dérive préoccupante pour la démocratie roumaine ».

Selon lui, ce projet n’aurait en outre jamais abouti sans l’implication directe de l’Église orthodoxe, majoritaire en Roumanie, dont les prêtres ont participé directement à la collecte de signatures, y compris dans les écoles.

La Cour constitutionnelle doit maintenant vérifier si cette proposition est conforme à la loi fondamentale. Si elle ne constate aucune irrégularité, la Roumanie devra organiser un référendum sur cette question.

En 2013, le Parlement avait renoncé à adopter un amendement en ce sens, suite aux critiques formulées par Accept, par le Conseil national de lutte contre la discrimination (CNCD) et par Amnesty International.

La Roumanie n’avait dépénalisé l’homosexualité qu’en 2000, après que le Conseil de l’Europe l’eut menacée de sanctions pour non respect des droits de l’Homme.

Several groups linked to the Orthodox Church and united under the umbrella Coalition for Family are seeking a constitutional amendment to narrowly define marriage as the « union between a man and a woman ».

It is the second such move in Europe this month after a group of mostly right-wing Italian politicians said they will push for a referendum to overturn the introduction of gay civil unions in their country.

« This is a historic moment, » said Mihai Gheorghiu, one of the leaders of the Romanian initiative, which has been given strong backing by the Church.

« Three million Romanians, in an unprecedented show of solidarity, signed this proposed amendment. »

The campaigners want parliament to change the wording of the current law which says marriage is a union between « partners », but they face strong opposition from gay rights groups.

« This initiative’s only goal is to incite public opinion against LGBT people, » countered Accept, a group that promotes the rights of the LGBT community.

This « offensive » is aimed at “further curtailing the rights of these minorities, » Accept member Florin Buhuceanu told AFP, denouncing a « worrying erosion of Romanian democracy ».

Parliament will have to verify that the petition accords with the law and if no irregularities are found, Romania will organise a referendum on the issue.

Rights groups including Accept, Amnesty International were were able to stave off a similar proposed amendment in 2013.

Homosexuality in Romania was illegal until 2000, when the country decriminalised it after harsh criticism from the European Union and the Council of Europe.
