Actuellement, l’article 2-6 du code de procédure pénale leur permet de se constituer partie civile pour des discriminations et violences, mais les exclut d’infractions graves comme la séquestration, le vol ou l’extorsion, même si ces actes sont motivés par par l'orientation sexuelle ou l'identité de genre des victimes.
